Release before trial
A bail hearing addresses whether an arrested person should be released while the criminal case proceeds, and on what terms. It does not decide guilt. Alberta’s first-appearance Justice of the Peace bail hearings operate across the province.
A workable release plan
The circumstances of the charge and the proposed release arrangements matter. A lawyer may ask about accommodation, work, support people and any existing court orders. Accurate information helps assess what can realistically be proposed; release is not guaranteed.
After the decision
Read any release order carefully and keep a copy. Ask about conditions you do not understand before acting. If release is refused, or conditions create difficulties, discuss the available review or variation process with counsel rather than assuming another hearing is automatic.
