A cap is not a complete claim valuation
Alberta’s minor-injury rules concern a defined category of injuries and limits on certain damages. An insurer’s description of an injury should not be treated as a complete legal assessment of the claim.
Use the rules for the relevant accident
The applicable amount and framework must be checked against the accident date and current legislation. Alberta publishes insurance bulletins and is changing its automobile insurance framework. This guide deliberately does not present one dollar figure as applying to every accident.
What to bring
Collect the accident date, medical records, treatment history and insurer correspondence. Explain how the injury affects daily activities and work. Counsel can assess the applicable rules and claim components before you decide whether to accept a settlement.
